PRIVACY POLICY

3SOFT S.A. (hereinafter referred to as “3Soft”) with its registered seat at ul. Gawronów 6, 40-527, in Katowice, Poland, and the website www.3soft.pl, will be the controller of your personal data (hereinafter referred to as “Personal Data”) and will undertake to protect it in accordance with the provisions of the Federal Act on the Protection of Personal Data Held by Private Entities and the relevant regulatory framework (hereinafter referred to as the “Act”).

In order to comply with the Act, we provide you with this Privacy Policy to inform you of the data we will collect from you, the purposes and other obligations in the order mentioned above.

Your use of 3Soft’s services means that you have read, understood and accepted each of the terms and conditions set forth in this Privacy Policy.

 

1. Data collected

3Soft may collect data that is necessary for the proper fulfillment of obligations arising from a business, commercial and/or legal relationship with you and/or the legal entity you represent, such as:

• identification data
• contact data
• Occubee system user data
• data necessary for the operation of the Occubee System and the realization of its functionalities
• data on the authority to represent a legal entity
• employee data
• tax data.

 

2. Purposes

The Personal Data you provide to us will be used for the following purposes:

• execution of contracts with Occubee customers
• provision of required services and products
• compliance with the commitments made
• ensuring proper operation of the Occubee System and realization of its functionalities
• providing information about changes or new products or services that are related to the contracted or acquired product or service
• providing information about offers, promotions or special events
• evaluation of the quality of our products or services.

In addition, as secondary purposes that are not considered mandatory for the maintenance of the commercial and/or legal relationship, Personal Data will be used for:

• contact purposes
• advertising or commercial purposes
• creating a database for research, statistical or market purposes.

You may refuse to have your Personal Data processed for the secondary purposes mentioned above by emailing us at the following address iod@3soft.pl.

 

3. Security

3Soft undertakes that regardless of whether Personal Data is collected by any physical, electronic, audio or virtual means, it will be protected in accordance with the highest standards of administrative, physical and technical security established by the Act, with necessary preventive measures taken to avoid damage, loss, destruction, theft, alteration and/or unauthorized use.

 

4. Processing

By providing us with Personal Data, you consent to its processing in accordance with this Privacy Policy both in and outside Mexico, directly or indirectly by 3Soft, its subsidiaries, affiliates or related parties, its customers, suppliers and/or third parties with whom 3Soft has a legal relationship, and, where applicable, by the competent authorities.
Please be advised that 3Soft may transfer Personal Data to any administrative, judicial or governmental body in Mexico or another country that requires it, provided that this has been established by a judicial or administrative judgment in accordance with the provisions of the relevant regulatory framework.

Likewise, 3Soft may share Personal Data with third parties when it intends to monitor compliance with the relationships, obligations and rights associated with the establishment of the relationship between you and/or the legal entity you represent and 3Soft, or in any of the cases provided for by the Act.

In the event of an international transfer of personal data, the data recipient will make reasonable efforts to comply with the same obligations that apply to 3Soft with respect to the processing of personal data, and to maintain the existing conditions under which you consented to the processing of the data.

 

5. Exercise of ARCO rights

In accordance with the provisions of the Act, as the owner of Personal Data or as a person who transfers Personal Data of the legal entity you represent, you have the right to:

• access the Personal Data we hold and the details of its processing
• rectify the Data, if it is incomplete or inaccurate
• delete the Data, if it is not required for any of the purposes indicated in this Privacy Policy or if it is used for purposes for which consent has not been obtained
• object to the processing of Personal Data provided to us for certain purposes; and
• revoke your consent to the processing of Personal Data.

Accordingly, you may request to exercise any of the above-mentioned “ARCO Rights” (Access, Rectification, Deletion, Objection or Revocation of Consent to Processing of Personal Data) in relation to 3Soft by sending a request via email to the following address iod@3soft.pl.

We may require you to verify your identity before responding to any request to exercise “ARCO Rights”.

If you choose to exercise your “ARCO Rights”, our privacy team can inform you of: (i) the information you need to provide for identification purposes and the documents you need to attach to your request; (ii) how long it will take to receive a response concerning the processing of your request; (iii) how you should submit your request, including which forms to use, if available; and (iv) the way in which we will provide you with information about the processing of your request.

 

6. Limitations

You have the right to restrict the use or disclosure of Personal Data for purposes that are not necessary for the concluded business, commercial and/or legal relationship with you and/or the legal entity represented by you, and therefore, in order not to receive messages other than compliance with established obligations, you may send a request to this effect via email to the following address iod@3soft.pl.

Likewise, you may revoke your consent to the processing of Personal Data at any time, but please be advised that not in all cases will we be able to respond to your request or immediately terminate the use of your data, as it is possible that there may still be business, commercial and/or legal obligations between you and/or the entity you represent and 3Soft, necessitating a case-by-case review.

 

7. Storage of Personal Data

3Soft will retain your Personal Data for the period established by the legal relationship entered into between you and/or the legal entity you represent and 3Soft in order to ensure compliance with the purposes for which it was collected, as well as with the laws, our internal policies and the provisions of the Act.

 

8. Use of cookies

Please be advised that our website uses virtual tracking tools such as cookies. Cookies can be understood as information sent by the website to your browser, which is stored on your computer’s hard drive and is used to determine your preferences when connecting to our website, and is also used to identify the behavior or actions performed by visitors to learn the characteristics of their browsing and perform analytical services to understand the effectiveness of our content and learn about the interests of our users, in order to improve the performance of our website.

In some sections of our site, we require users to have cookies enabled because some features or bookmarks require them to function optimally. Each time this site is used, information may be stored using cookies and other technologies.

9. Changes to the Privacy Policy

This Privacy Policy may be subject to modifications, changes or updates in connection with the products and services offered by 3Soft, as well as new legal requirements, 3Soft’s own needs, changes in privacy policies and/or our business model, and therefore any changes to this Privacy Policy will be indicated and available through https://occubee.com/en/privacy-policy-me/ and or the means that 3Soft deems appropriate for such purposes.
